TERMS & CONDITIONS - PLEASE READ CAREFULLY Responsibilities and Liability 1. Europebyair.com acts only as a booking agent and has no control over, or responsibility for, any of the tickets, coupons, carriers, or other travel accommodations as listed in this brochure. All bookings are accepted and all tickets are issued on the express condition that europebyair.com is not responsible or liable for: any loss (consequential or otherwise); damage (including but not limited to loss of, or damage to passengers clothes, baggage, or other property whatsoever); death, injury, delay, missed connections, inconvenience or irregularity caused by, or arising out of, or in connection with, incidents or political unrest; any defect in any vehicle or other air, land or sea conveyance used, rented or traveled in; or through the negligence, willful misconduct, strikes or other acts, defaults, cease of operations, change of schedules, or omissions of any carrier, car rental company, hotel, restaurant, or any other provider of goods or services except as covered by the ticket Protection Plan, or any acts of God. 2. Every booking is accepted subject to the conditions, tariffs and regulations imposed by the air, rail, shipping, bus, car rental, car insurance, hotel or other companies, firms or persons concerned. 3. Travelers are responsible for ensuring that they have all necessary visas and appropriate travel documents prior to their departure. 4. All prices and product characteristics are subject to change without notice. 5. Every effort has been made to ensure that all information appearing in this brochure is correct and exact. However, europebyair.com cannot accept responsibility for human or printing errors or changes in prices/fees that may be imposed upon europebyair.com, after publication by the European Airlines, or other providers of services mentioned on this site. 6. All products in this brochure must be purchased in North America or other European countries. All prices indicated are effective April 15th, 1998, unless stated otherwise, and are subject to change without notice. General Terms and Conditions for europebyair.com Fight Passes To Purchase europebyair.com Flight Passes can only be issued to citizens and permanent residents of non-European countries. How to validate your tickets Tickets are valid for 120 consecutive days from the date indicated on the ticket under the column "NOT VALID BEFORE". All air travel must be completed within the validity dates on the ticket. All travel must be completed by midnight on the date of the last ticket, in local time at the final europebyair.com departure airport. Under no circumstances is the ticket holder to enter any information on the ticket. Tampering with or altering the ticket renders the ticket void and authorizes any participating airline staff, or representative of europebyair.com, to confiscate the altered ticket and all other tickets purchased by the ticket holder, with no compensation to be paid to the holder of the altered ticket or any representative of the holder of the altered ticket. Tickets are strictly non-transferable and are only valid for those whose name appears on the ticket. Use by anyone other than those named will invalidate the ticket and result in ticket confiscation. It is compulsory to present passports to any official of any carrier, or agent of europebyair.com, on request. You are strongly urged to make reservations prior to departure. europebyair.com Flight Passes are good in booking classes provided by contract carriers. Classes of service for the europebyair.com program are not always available. europebyair.com in no way assumes liability for any circumstance in which a ticket holder is not provided with, or cannot attain boarding on any aircraft due to seats in contract class of service being unavailable. General Refund/Exchange Policy Lost or stolen tickets are neither refundable nor replaceable, except for those tickets as covered by the europebyair.com Protection Program. Non-refundable fees include, but are not limited to: handling fees and shipping charges. Purchase of the ticket Protection plan is strongly recommended. Any charges associated with the replacement of tickets and shipping charges is solely the responsibility of the ticket purchaser. Advanced Booking Please apply for your tickets at least 15 days prior to your departure. Europebyair.com, will always try to help if less notice is given, but is not responsible for delays in delivery service or otherwise. If tickets are ordered at short notice, europebyair.com will charge an additional fee for overnight delivery service, as well as an additional administration fee. When ordering please include your date of departure. Additional Charges All taxes for air travel are the responsibility of the ticket holder. Taxes are to be paid at the ticket sales desk of participating air carriers, in local currency, at every point of departure where required. Every flight taken under the europebyair.com Program is considered a one way, non-stop flight. No connections are allowed. A "no-show" for a pre-reserved reservation is cause for forfeit of the required tax, and invalidation of the required ticket assigned to that specific reservation. A "no-show" is defined as any person or persons who have confirmed reservations on any carrier and do not fly on the reserved flight without cancelling the reservation within 24 hours prior to time of departure. Venue and Attorney Fee's Any lawsuit arisen from the terms and conditions herein shall be governed by laws of the State of California. Parties to such suits shall submit to the jurisdiction of competent courts situated within the City of Phoenix. The prevailing party to such suit shall be rewarded reasonable attorney's fees. Retention of the europebyair.com by you, your representative, or travel companies shall constitute acceptance of the terms and conditions herein.
